General Terms & Conditions of Starry Promotions

By participating in a Starry, Inc. promotion, including without limitation any contest, raffle, giveaway or other promotion (for purposes of these Terms & Conditions, we refer to any of these promotions as a “promotion”) pursuant to which you will receive remuneration in any form from Starry (for purposes of these Terms & Conditions, we refer to any remuneration you may receive as a “promotional payment”), you agree as follows:

  1. You are fully and unconditionally bound by these Terms & Conditions. You represent and warrant to Starry that you meet the eligibility requirements for the relevant promotion. In addition, you agree to accept the decisions of Starry relating to the operation of the promotion as final and binding.

  2. Promotional payment(s) that may be awarded to the eligible recipient(s) are not transferable, redeemable for cash or exchangeable for any other payment. All promotional payments must be redeemed within 45 days of the promotion end date.

  3. Starry promotions are open only to those who sign up following the rules of the specific promotion. You must be at least 18 years old as of the date of entry. Starry promotions are only open to legal residents of the United States and are void where prohibited by law. Employees of Starry and their immediate family members and/or those living in the same household as any employee or immediate family member are not eligible to participate in any Starry promotion.

  4. Each Starry promotion is subject to all applicable federal, state and local laws and regulations and is void where prohibited.

  5. For any promotion where fewer than all participants win promotional payment(s), your odds of winning depend upon the number of participants in the promotion.

  6. Starry disclaims all liability for any delays, mis-delivery, loss or failure in the delivery of any item sent by mail, courier, electronic transmission, or other delivery method. Starry is not responsible for technical, electronic, communications or computer malfunctions or failures of any kind, including, failed, incomplete, garbled or delayed transmission of online entries, which may limit your ability to participate in a promotion.

  7. You agree to waive any and all claims of loss or liability against Starry, its employees and agents for any personal injury or loss which may occur from the conduct of, or your participation in, a promotion, or from your acceptance, possession or use of any promotional payment. In order to receive a promotional payment, you may be required by Starry to sign a waiver form provided by Starry.

  8. Any valuation of a promotional payment will be based on available information, and the value of a promotional payment given to you may be reported for tax purposes as required by law. Each recipient of a promotional payment is solely responsible for reporting and paying any and all applicable taxes related to the payment and paying any expenses associated with the payment. Starry may require each recipient to provide Starry with valid identification and a valid taxpayer identification number or social security number before a promotional payment will be awarded. Any person receiving over $600 in promotional payments from Starry in any year will receive an IRS form 1099 at the end of the calendar year and a copy of such form will be filed with the IRS.

  9. Starry reserves the right, in its sole discretion, to cancel, terminate, modify or suspend a promotion if fraud or other causes beyond Starry’s control affect the administration, security, fairness or proper conduct of the promotion. Starry reserves the right at its sole discretion to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of a promotion or violates these Terms & Conditions. Starry has the right, in its sole discretion, to maintain the integrity of a promotion, to void entries for any reason, including, but not limited to, multiple entries from the same entrant in excess of that allowed by a promotion’s rules or the use of bots, macros or scripts or other technical means for entering electronically.

  10. Each Starry promotion is governed by the laws of the United States and the Commonwealth of Massachusetts, without respect to conflict of law doctrines. As a condition of participating in a promotion, you agree that all disputes which cannot be resolved between you and Starry, and all causes of action connected with any promotion, will be resolved individually, without resort to any form of class action, exclusively before a court located in the Commonwealth Massachusetts having jurisdiction. Further, in any dispute, under no circumstances will you be permitted to obtain awards for, and you hereby waive all rights to claim, punitive, incidental, or consequential damages, including reasonable attorney’s fees, and you further waive all rights to have damages multiplied or increased.
